The purpose of PIER MAUÁ's Privacy Policy is to demonstrate the organization's commitment to the privacy and security of personal data.

It informs how personal data will be processed and disposed of, as well as ensuring that information is not provided or shared improperly, in compliance with current legislation and the General Personal Data Protection Law - LGPD (Law No. 13,709/2018).

This website is operated by Simples.net - Marketing Digital, which undertakes to comply with the provisions of the LGPD.

In addition to this website, PIER MAUÁ may collect personal data from employees, clients, contractors, visitors and partners through other corporate social networks, as well as direct contact with our team, exclusively through corporate e-mail.

By accessing the PIER MAUÁ website and providing their personal data, users are aware of the provisions of this Privacy Policy, as well as their rights as holders of personal data.

The Privacy Policy relating to PÍER MAUÁ employees is dealt with in the company's internal rules.

1.DEFINITIONS

The controller is the natural or legal person, in the public or private sector, who has decision-making power over the processing of personal data. The operator, on the other hand, is the natural or legal person, in the public or private sector, who processes personal data on behalf of the controller, i.e. according to its instructions.

Data on children and adolescentsThe use of children's and adolescents' data also requires additional care; it will only be processed in accordance with the LGPD and when strictly necessary. According to the Child and Adolescent Statute, a child is an individual up to the age of 12, and an adolescent is an individual between the ages of 12 and 18.

Data processingany operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as cataloguing, recording, organizing, structuring, storing, adapting or altering, collecting, consulting, using, disclosing by transmission, disseminating or in any form making available, aligning, combining, restricting, erasing or destroying.

Legal basis (data processing hypothesis)is the justification, based on the LGPD, for the controller processing the data subjects' data. The legislation prohibits the collection and processing of data for which there is no legal provision in the LGPD.

Pier Mauá website - EVENTS and ANNOUNCEMENTS

The data subjects are clients interested in quotes and hiring a venue for events, or their representatives.

The personal data collected is: full name and e-mail address.

This data will be collected for commercial purposes, and will be kept on the basis of the hypothesis of EXECUTION OF CONTRACT (contracts in progress) and REGULAR EXERCISE OF RIGHT (after provision of the service by PIER MAUÁ).

 

Pier Mauá website - CONTACTS 

The site also collects data from users interested in offering services, products or sending CVs.

The personal data collected is: full name, ID, e-mail address. 

The purpose of this collection is to keep a register of partners, possible candidates or clients interested in various requests.  

All the information collected is forwarded to the responsible sectors and processed in accordance with the legal basis applicable to each situation.

 

Hiring service providers 

 The data subjects are representatives and partners of the companies providing the service, as well as PIER MAUÁ managers.

The purpose of data collection and processing is in accordance with the stages:

  • when formalizing the contract for the provision of services and the rental of spaces for events or fixed events. The personal data collected is: full name, CPF, e-mail, ID, address, marital status of the representatives of the contractor and the contracting party (PIER MAUÁ's board of directors and/or managers). 
  • When granting access to port areas, the personal data collected is: full name, CPF, ID, photo and video images. The purpose of data collection is to ensure the safety of the site and those involved, as well as compliance with the legislation of the port authorities and the Federal Police.
  • in the fulfillment and termination of the contract, in particular quality, safety and occupational health requirements. Personal data includes: full name, CPF, ID, photo and video images, occupational exams, proof of qualifications and training.

When hiring service providers, the LEGAL BASIS is the EXECUTION OF THE CONTRACT (contracts in progress), REGULAR EXERCISE OF THE RIGHT (after the contract has ended), and also the FULFILLMENT OF LEGAL OBLIGATION, in relation to possible demands from third parties (labor, social security and tax legislation).

 

Certification audits

The data subjects are the auditors, the managers of PIER MAUÁ, and other auditees, whose personal data are: full name, e-mail address, position/function.

The purpose of the audits is to demonstrate compliance with occupational health and safety processes and requirements, in compliance with port technical and legal standards.

Personal details are: full name, e-mail address, job title.

When carrying out audits for certification, the LEGAL BASIS is FULFILLMENT OF LEGAL OBLIGATION.



DATA SUBJECTS' RIGHTS

In accordance with the LGPG, every PERSONAL DATA SUBJECT has the following rights in relation to the database under the responsibility of PIER MAUÁ:

  • confirm the existence of data processing in a clear and objective manner;
  • access their data, and may request a copy in physical or digital form, at no cost to the holder;
  • request that your data be corrected or updated;
  • request the anonymization or deletion (DISPOSAL) of their data, when the legal basis is CONSENT or LEGITIMATE INTEREST. Depending on the analysis, the data subject may also request deletion from the database; 

 

SHARING PERSONAL DATA:

PIER MAUÁ shares personal data externally only in the following situations:

  • Clearance of access to port areas: data shared with the Federal Police, CDRJ and the company operating the electronic access system;
  • Maintenance of own IT and computer resources: data shared with specialized technology contractors and telephone operators.
  • Occupational health and e-social management: data shared with a digital technology company specializing in occupational safety, health and e-social management. 
  • Audits of quality and environmental management standards: data shared with environmental agencies (INEA, IBAMA), public administration and inspection bodies (ANTAQ, ANVISA, CDRJ), specialized consultants and certification bodies.

 

STORAGE AND PROTECTION OF PERSONAL DATA

The information entered by users on the Píer Mauá website is stored on servers (electronic data), using best cybersecurity practices. Just like the other data collected electronically in the company's other internal processes. If data is collected physically, it will be kept in cabinets with access limited to the sector and function responsible.

In the case of external sharing, the contracted companies (operators) must follow this Privacy Policy, in addition to maintaining the appropriate administrative and technological security actions aimed at information security and the privacy of the data subjects' personal data.

Some data may be kept for longer than required by law, for internal Pier Mauá reasons. And they may be deleted at the request of the data subject.

 

DELETION OF INFORMATION

Personal data will be discarded in the following situations:

  • termination of the purpose for processing the data;
  • expiry of the statute of limitations for the document or claim, when the LEGAL BASIS is FULFILLMENT OF A LEGAL OBLIGATION.
  • at the request of the data subject, when the LEGAL BASIS is consent or LEGITIMATE INTEREST.
  • at the request of the ANPD, in accordance with the LGPD.  

 

UPDATING THE POLICY

This version of the Privacy Policy was updated and published on 17/08/2022, and may be modified whenever PIER MAUÁ deems it necessary. 

Whenever changes are made, they will be published to inform the owners.

Should the DATA SUBJECT wish to request access, correction, updating or deletion (where appropriate) of the data collected, he/she may contact PIER MAUÁ's Data Controller, stating the conditions under which the data was collected and its identification.
